end user licence agreement

1. the licence

Pardy on iPhone and iPad is licensed to you under Apple's Licensed Application End User Licence Agreement, which you can read here: apple.com/legal/internet-services/itunes/dev/stdeula . That agreement applies in full. This page adds the terms that are specific to Pardy, and where the two conflict on anything Apple's agreement covers, Apple's wins.

Pardy on Android is licensed to you by [COMPANY LEGAL NAME] on the same terms set out on this page, together with the Google Play Terms of Service.

You get a personal, non exclusive, non transferable, revocable licence to install and use Pardy on devices you own or control, for your own use. You may not copy it, sell it, sublicense it, rent it, reverse engineer it, or work around its technical limits, except where the law says you may despite this paragraph.

Your use of Pardy is also governed by the terms of service and the privacy policy.

2. Pardy Premium

Pardy Premium is an optional auto renewing subscription. Buying it is not required. The game is fully playable without it and always will be.

what it includes

• taps to the cap on your own nights. When you are the hot seat you can keep tapping words to reveal them, up to the same two thirds of a sentence limit everyone has. A sentence can never be fully revealed by paying, by anyone. Every tap is broadcast to your circle exactly as a free tap is.
• custom theme pairs, on top of the curated presets everyone gets.
• an alternate app icon pack, from a set of designs bundled in the app.
• personal streak repair. Repairs your own streak only. The circle streak your whole group shares can never be repaired with money.

what it does not do

Premium only adds. It has never taken anything away from the free game, and it will not. Specifically:

• your score is not purchasable
• the circle streak is not repairable with money
• everything you buy that touches the game is visible to your circle, so there is no invisible advantage
• every cap that applies to a free member applies to a Premium member too

price and billing

Pardy Premium is offered monthly and yearly. The reference price is [PRICE: 3.99 per month and 29.99 per year in the reference storefront, GB], and the price in your own country is the one your store shows you at the moment you buy, in your own currency, including any tax. The price shown to you in the App Store or in Google Play at the moment of purchase is the price that applies.

The subscription renews automatically. Payment is charged to your Apple or Google account when you confirm the purchase, and again at each renewal. A monthly subscription renews every month and a yearly one renews every year. It keeps renewing until you cancel it, and it renews at least 24 hours before the current period ends. Your account is charged for the renewal within 24 hours of the end of the current period.

how to cancel

Cancel through your device, not through Pardy. We cannot cancel it for you, and deleting the app does not cancel it.

• iPhone or iPad: Settings, tap your name, then Subscriptions, then Pardy, then Cancel. Or open apps.apple.com/account/subscriptions.
• Android: the Google Play app, tap your profile picture, then Payments and subscriptions, then Subscriptions, then Pardy, then Cancel. Or open play.google.com/store/account/subscriptions.

Cancel at least 24 hours before the next renewal date or that renewal still goes through. When you cancel, Premium stays active until the end of the period you already paid for, then stops. Nothing you did while subscribed is taken away from you: taps you already spent stay spent, streaks you repaired stay repaired, and you go back to the free game, whole.

refunds

Refunds are handled by the store you bought from, not by us. We cannot issue one.

• Apple: request a refund at reportaproblem.apple.com. Refunds are at Apple's discretion under its own terms.
• Google: request a refund through the Play Store order history, or Google Play support.

If you are a consumer in the UK or the EU you have a statutory right to cancel a purchase within 14 days. Because Premium starts immediately, you agree at purchase that it starts before that period ends, which may reduce or end that right under your local law. Nothing here removes a right your local law gives you. [COUNSEL: confirm the withdrawal right wording against the Consumer Rights Directive and each launch market.]

changes to the subscription

If we change the price or what Premium includes, we will tell you before it takes effect and, where the law requires it, ask you to accept the change. You can always cancel. We will not move a feature that is free today behind Premium.

3. buying if you are under 18

If you are under 18, do not buy Premium without permission from the person who owns the payment method. Ask a parent or guardian first. Parents can turn purchases off entirely with Screen Time on iPhone and iPad, or with parental controls in Google Play.

4. support and warranty

[COMPANY LEGAL NAME] is solely responsible for Pardy and for supporting it. Apple and Google have no obligation to support it. If Pardy does not work, contact us at email us or through the support page. On iOS, if the app fails to conform to any warranty, you can notify Apple and Apple will refund the purchase price of the app itself, and to the fullest extent the law allows Apple has no other warranty obligation.

Apple and Google are third party beneficiaries of this agreement and may enforce it against you.

5. governing law

This agreement is governed by the law of [GOVERNING LAW JURISDICTION], on the same terms and with the same consumer protections set out in section 13 of the terms of service.
